Terms and Conditions
1. Nature of the Program
DepartaCare provides post-disruption financial assistance only. DepartaCare does not influence, intervene in, or attempt to affect decisions made by airlines, immigration authorities, or any government agency.
2. Covered Event
The only covered event under this Program is a verified denial of departure ("offloading") by Philippine immigration authorities at the official point of departure.
3. Exclusions
Assistance is not provided for flight cancellations or delays, weather-related disruptions, airline operational or technical issues, overbooking, visa denial, or any travel disruption not directly related to immigration offloading.
4. Membership Registration
Membership must be registered at least three (3) calendar days prior to the declared departure date. Same-day or last-minute registrations, including those made one (1) day before departure, will not be accepted. Each membership is valid for one (1) declared trip only.
5. Membership Fees
Membership fees are service fees and do not constitute insurance premiums. Fees are non-refundable once the declared departure date has passed. DepartaCare does not fully reimburse airline tickets, as it is not an airline, travel agency, or insurance provider. Any assistance granted is partial and discretionary.
6. Assistance Limits
Assistance amounts are subject to the member's selected plan and applicable program limits.
6.1 Higher Claim Consideration (No Member Fault)
Assistance may be considered at a higher level where the denial of departure occurs despite complete and valid travel documentation, and where no act, omission, negligence, or misrepresentation is attributable to the member. All cases remain subject to internal assessment and plan limits.
6.2 Moderate Claim Consideration
Assistance may be considered at a moderate level where the denial of departure is accompanied by an official explanation from immigration authorities and where circumstances do not clearly indicate member fault, but require further clarification or supporting documentation.
6.3 Low or No Claim Consideration
Assistance may be limited or denied where the denial of departure arises from:
- False, misleading, or incomplete information provided by the member
- Failure to comply with standard travel, immigration, or documentation requirements
- Circumstances clearly attributable to the member's own acts, omissions, or negligence
7. Proof and Documentation
Members must submit proof of denial of departure, valid government-issued identification, and official receipts for non-refundable expenses. DepartaCare may request additional documents for verification purposes.
8. Claim Filing Deadline
All claims must be submitted within three (3) calendar days from the date of denial. Claims submitted beyond this period will not be processed or accepted.
9. Processing Time
Claims are reviewed within five (5) to ten (10) business days upon receipt of complete documentation. Simple cases may be released within three (3) working days, subject to verification and approval.
10. Discretionary Nature of Assistance
All assistance decisions are fully discretionary. Submission of documents does not guarantee approval or assistance.
11. Misrepresentation and Fraud
Submission of false, misleading, or fraudulent information or documents will result in claim denial and termination of membership without refund.
12. Limitation of Liability
DepartaCare shall not be liable for indirect, incidental, or consequential losses, including loss of opportunity or emotional distress.
13. Force Majeure
DepartaCare is not responsible for delays or failures resulting from events beyond reasonable control, including natural disasters, government actions, or system disruptions.
14. Official Communication
DepartaCare may provide assistance and guidance through official communication channels such as phone calls, messaging platforms, or email. Only written confirmations issued through official DepartaCare channels shall be considered binding for claims, eligibility, or assistance determinations.
15. Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of the Republic of the Philippines.
16. Data Privacy
DepartaCare collects and processes personal information solely for registration, verification, and claim assessment purposes, in accordance with applicable data privacy laws. Information will not be shared except as required for verification or legal compliance.
17. Amendments
DepartaCare reserves the right to amend or update these Terms and Conditions at any time. Any updates shall apply prospectively and will be made available through official channels.
18. Severability
If any provision of these Terms and Conditions is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
